FINDWATT PRIVACY STATEMENT AND POLICY

This Privacy Statement and Policy (the “Policy”) informs users of https://findwatt.com/ and any other websites (collectively, the “Site”). controlled or operated by ATTRICORP INC., d/b/a “FINDWATT,” a Delaware corporation, and/or its owner, agents, employees, representatives or affiliates and assigns (the “Company,” “we,” “us,” or “our”). The Company gathers and uses (i) personal information submitted to the Site and (ii) aggregated information collected from the services provided through the Site. This Policy applies to the Site, and any domains, services, applications and applicable products (“Services”). Our commitment to you is that whenever we collect and process information from you, we will do so with your benefit in mind. Please read this Policy carefully. If you do not agree with the terms of this policy, do not disclose your information on the Site. From time to time we may update this Policy, at our sole discretion. When we make any changes, we will update the “Revised” date of this Policy. Your use of the Site after an updated Policy becomes effective will indicate your acceptance; therefore, we encourage you to periodically review this Policy and the Sites to keep apprised of our current privacy statement. All definitions and terms appearing in this Policy that are not herein defined shall have the same meaning ascribed to them under the Terms of Service, unless context demands otherwise.

1. INFORMATION PROVIDED

You hereby declare and agree that all the information you provide to us and/or update and/or share with the Company and others on the Site is correct, reliable and accurate, and that you registered and/or provided the information in your own name and on your own behalf, and not in the name and/or on the behalf of any third party, excluding cases in which you are explicitly permitted to do so under the Terms of Service, including this Policy and/or the specific conditions.

2. USE OF INFORMATION

The Company collects and uses your personal information to manage and enhance your use of the Site or the Services. The types of information we may collect can vary depending on how you access, visit, use or otherwise take advantage of the Site or the Services. The Company does not share any information provided by you with any third parties unrelated to the Services, but it may share information with third party partners who support and promote the Site and/or are in the business of the Services provided through the Site. The Company, however, may share some limited information, with unrelated third parties as provided for herein. However, without your consent, such shared information will be aggregated or modified so that you will not be identified with such information. The Company may also use and allow third parties to track your browsing history profile. Such tracking will allow the Company to offer you specifically tailored services and products.

Some of the Services may require registration. In those cases, as part of the registration, you may be required to provide personal information, including without limitation, your first and last name, phone number, and ways of contacting you, or your email address. You may also provide information about a third party through the Services. We may combine this information with other information we collect from your interaction with the Services or from other companies. Without providing some of the data requested, you may not be able to use the Services.

Having accurate information about you permits us to understand your needs and provide you with better Services. In particular, the Company may use your personal information for the following:

  1. (a) To manage and enhance your use of the Site or the Services.

  2. (b) To periodically send you promotional emails about new products, special offers, and other information that may be of interest.

  3. (c) To send or facilitate communications between you and third party providers regarding your business needs or interests.

  4. (d) With third parties with whom you choose to let us share information, for example other apps or websites that integrate with our application or Services.

  5. (e) To compile anonymous statistical data and analysis for use internally or with third parties.

  6. (f) With vendors, consultants, marketing partners, and other service providers who need access to such information to carry out the Services on our behalf.

Although we endeavor to keep your information as private as possible, there are certain situations in which we may need to disclose your personal information. Therefore, we may also disclose your personal information if: (a) It is required to comply with the law or a legal process; (b) we believe it is necessary to protect the safety of yourself or others, as well as our Company; or (d) You grant us permission to disclose such information. Any such release decisions may be made by us in our sole discretion.

3. SHARING INFORMATION

We may share your information under the following circumstances: (a) We may transfer your information to third parties that perform services for us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service and to assist us in our marketing efforts; (b) If we reorganize or sell or a portion of our assets, undergo a merger, or are acquired by another entity, we may transfer your information to the successor entity. You acknowledge that such transfers may occur and that the transferee may decline to honor commitments we made in this Policy; (c) if you interact with other users of the Site and Services, your posts may be viewed by all users and may be publicly distributed in perpetuity; and (d) we may share with third parties, including the public (e.g. through white papers or press releases) aggregated information in a form that does not disclose your personally identifiable information for industry analysis.

4. COOKIES DISCLAIMER

When you visit the Site, a cookie may be saved on your computer, and if you return to the Site the cookie may be read. A “cookie,” is a small text file placed on the user's hard drive to track usage of the Site and collect basic information, which may include certain of your preferences.

The Company uses cookies and other data collection tools like web beacons to collect data that help us personalize your use of the Site or to assist with the Services. By using this technology, we are able to make it easier for visitors to browse the Site and use the Services. Cookies may also help to prevent you from having to register or re-enter your information every time you visit the Site in a streamlined fashion. For example, if you request that we save your password for automatic sign on, we may record your encrypted password in a cookie file. Aggregate cookies and tracking information that does not directly identify you may be shared with third parties.

If you would like to avoid cookies, your web browser may have an option that enables you to disable or not accept cookies. Please note that should you disable or not accept cookies, portions of the Site may not properly function and some features or activities may not be available to you (for example, you may not be able to complete your transaction)..

We use analytics companies (e.g. Google Analytics) to track your use of Services, so that we can improve the Site and Services.

We currently do not, and have no plans to, work with advertisers, advertising networks, or advertising servers (“Advertising Services”). However, we reserve the right to work with such Advertising Services, to deliver to you advertisements based on your interests and online activities.

Both the analytics companies and Advertising Services may use various technologies including cookies to collect data about your use of the Site and/or Services. These companies use cookies or other files with a unique identifier, which are included in the internet pages, and which are intended to assist the collection of information about the views and use of the Site. The information collected is not used to personally identify you, but is only intended to customize the advertisements you are shown in accordance with your fields of interest.

The use of cookies and other files made by the analytics companies and Advertising Services are subject to the privacy policies of their companies, and not to our privacy policy. We cannot exert control over the privacy policies of other companies so, if you wish to review the privacy policies of companies advertising on the Site, you must do this through their websites or applications. Please note, however, that we currently do not use Advertising Services and, should we do so, we will take the applicable companies’ privacy policies into account when making our selection.

On most mobile devices, you can control the interest-based ads you see in two different ways: (1) changing the privacy settings of the device itself; and (2) changing the privacy settings of your browser. In addition, please note that if you use ad blocking software on your device, this may interfere with certain features and cause a disruption of service.

5. OTHER TECHNOLOGY AND CONTROLS FOR DO-NOT-TRACK FEATURES

We may use other technologies to capture specific data, such as the pages you view, the items you download, the links you click, your access times, and your Internet Protocol (IP) address, domain name, and system configurations and settings, to help us understand how you use our technologies, serve you relevant content, and to assist you with questions you may have regarding our Services. We may capture this data to provide you with access to information about your business relationship with us and to facilitate your use of the Site and Services.

Most web browsers and some mobile operating systems include a Do Not Track (“DNT”) feature or setting, where users can indicate preferences regarding tracking and cross-site tracking when they visit certain sites. Our Site does not currently respond to DNT browser signals or any other mechanism that automatically communicates your preference to be tracked online across third party websites. However, we do not track such browsing activities and, while we cannot provide an absolute guarantee of future intent, we do not plan to do so at this time. No uniform technology standard for recognizing and implementing DNT signals has been finalized. Because there is not yet a common understanding of how to interpret the DNT signal, we currently do not use technology that recognizes or responds to DNT signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about the practice in a revised version of this Policy.

6. THIRD PARTY SERVICES AND PRODUCTS

Some third-party services or products may be referenced or listed in the Site. These services are provided using those third-party’s computers. When using those services or products, some of your device's details, personal details, or information about you may be collected. The use of that information is subject to those service administrators' privacy policies, and not this Policy, and for this reason, we recommend that you also review their privacy policies.

YOU AGREE TO TAKE ALL NECESSARY PRECAUTIONS IN ALL INTERACTIONS WITH OTHER USERS, PARTICULARLY IF YOU DECIDE TO PROVIDE PERSONAL INFORMATION PRIOR TO FULLY EVALUATING THE USER YOU ARE COMMUNICATING WITH.

7. SOCIAL MEDIA/THIRD PARTY PLATFORMS

By accessing the Services using your social networks credentials or any other third party services, you permit us to access certain information from your profile on such social networks or any other such third-party services for use by the Services. You may be able to control the amount of information that is accessible to us by adjusting your account privacy settings on social networks or any other such third-party services. By using the Services, you are authorizing us to collect, store, retain, and use indefinitely, in accordance with our Policy, any and all information that you permitted the social networks, or any other such third-party services, like Amazon, to provide to us. However, we will not make any disclosure of such information and we will not post anything regarding the Site or the Services in your account with such social networks or any other such third-party.

8. SECURITY DISCLAIMER

WHILE WE ATTEMPT TO ENSURE YOUR ACCESS AND USE OF THE SITES IS SAFE, COMPANY DOES NOT REPRESENT OR WARRANT THAT THE SITE OR SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THEREFORE, UNFORTUNATELY NO DATA TRANSMISSION OVER THE INTERNET NOR ANY STORAGE OF INFORMATION ON SERVERS OR OTHER MEDIA CAN BE GUARANTEED OR MADE TO BE 100% SECURE; AND WHILE WE STRIVE TO PROTECT PERSONAL INFORMATION, AS OUTLINED IN THIS POLICY, WE CANNOT PROMISE, GUARANTEE OR WARRANT THE COMPLETE SECURITY OF INFORMATION.

9. MARKETING MESSAGES

With respect to marketing messages, we may send you periodic e-mails about the Services that may be of interest of you to the email address you provide to us, if you are a registered account holder or, in the alternative, by signing up for e-mails about our Services. If you no longer desire to receive such promotional e-mails, follow the unsubscribe instructions in any e-mail or social medial message you receive from us. We will process your request as soon as it is reasonably practical and you will not be contacted again unless you re-register for an account. Please note that we may still send you administrative or transactional messages about the Services. In addition, you may choose at any time to stop receiving such promotional information by contacting us at stoppromotionalemails@findwatt.com, which allows you to opt-out from receiving further correspondence.

10. CHILDREN’S INFORMATION

Our Services are not directed to children. We do not knowingly solicit information from or market to children under the age of 18. If we learn that personally identifiable information from users of the Site or Services less than 13 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such information from our records. If you become aware of any personal information we have collected from a child under the age of 13, please contact us at removepersonalinformation@findwatt.com, if you are under the age of 18, reside in California, and have a registered account on our Site, you have the right to request removal of unwanted information that you publicly post on our Site. To request removal of such information, contact us using the email address associated with your account at removepersonalinformation@findwatt.com and include a statement that you reside in California. While we will make sure the information is not publicly displayed on our Site, please be aware that the information may not be completely or comprehensively removed from our systems.
